Stanley Blumenthal and Dick Farrel talk politics on Yom Kippur

An interesting guest returns to AM 740 WSBR and AM 1470 WWNN on Yom Kippur as veteran radio host Dick Farrel fills in on The Credit Report with Bill Lewis.

Comrade Stanley Blumenthal - an “independent socialist” congressional candidate – is making a return appearance to local political radio.

Blumenthal, an eccentric 87 year-old retired Merchant Marine and self described Socialist, is making his second run for Congress an NPA for US Congress in Florida’s District 25.  He is running against Mario Diaz-Balart (R-Miami) and Eddie Gonzalez, a Hialeah man who recently garnered attention by legally changing his name to VoteForEddie.com.

Spending tens of thousands of dollars with his full-page advertisements in The Miami Herald and Sun Sentinel, Blumenthal wrote about the economic threat posed by communist China, urged Americans to by “patriotic” T-bills and warned that neither political party would solve America’s economic problems.

“The American Dream has been outsourced to commie China, India, Mexico, Brazil, etc. by the money hungry job creators looking for the biggest bang for their buck treating their American workers like disposable cups and not caring about our USA problems,” Blumenthal stated.

Concluding his manifesto, Blumenthal chimed: “We are a big country so why are most of our jobs in the small and medium businesses? Shouldn’t the biggies like GE, IBM, Motorola, etc be made to supply their fair share of jobs? Shall we let commie China, etc get the heavy big high employment industries and the USA the small stuff? A Marxist principal: Workers should be paid enough to move the goods and services off the shelves. Anyone disagree? Note, Communist run China is now considered to have the 2nd highest economy next to ours in the world and moving up fast.”

Blumenthal promises to “shake-up” the political establishment as a “Socialist” or “American Patriotic Communist.”  In a race that boosts a strong Republican incumbent in Mario Diaz-Balart and the “VoteForEddie.com” domain name as a candidate, Elect Comrade Blumenthal is the motto of his campaign.

Florida’s 25th Congressional District includes parts of Broward, Collier and Miami-Dade counties.

It’s Official: Facebook to Start Charging Users

Now that I have your attention, the above statement is false.

Following yet another change at Facebook, a new version of an old hoax is spreading throughout the Internet warning users that the company will soon start charging for their service.

Starting early last week, many of my Facebook friends and fans sent private messages and texts seeking advice on whether they should join the new subscription service or move their friends to Google +

So widespread was the rumor that the subject was topic of numerous conversations during Presidency 5 and CPAC in Orlando last week.  Many politicians and political strategists were openly wondering whether they would now have to pay for someone to “Like” them.

In fact, several of my colleagues openly questioned this “new policy” while watching the Fox Presidential Debate and munching on Google candy in the media center of the Orange County Convention Center.

The rumor – which is spreading as a chain letter on Facebook – warns users that the world’s largest social network will soon start charging as a result of upcoming profile changes.  Notwithstanding the Facebook disclaimer that “It’s free and always will be,” hundreds of thousands have fallen for this hoax.

The posts have been reported in numerous languages and in numerous countries:

“IT IS OFFICIAL.  IT WAS EVEN ON THE NEWS.  FACEBOOK WILL START CHARGING. DUE TO THE PROFILE CHANGES.  IF YOU COPY THIS ON YOUR WALL YOUR ICON WILL TURN BLUE AND FACEBOOK WILL BE FREE FOR YOU.  PLEASE PASS THIS MESSAGE ON,  IF NOT YOUR ACCOUNT WILL BE DELETED IF YOU DO NOT PAY.”

Another post offering various levels of Facebook membership:

“FACEBOOK JUST RELEASED THEIR PRICE GRID FOR MEMBERSHIP. $9.99 PER MONTH FOR GOLD MEMBER SERVICES, $6.99 PER MONTH FOR SILVER MEMBER SERVICES $3.99 PER MONTH FOR BRONZE MEMBER SERVICES, FREE IF YOU COPY AND PASTE THIS MESSAGE BEFORE MIDNIGHT TONIGHT. WHEN YOU SIGN ON TOMORROW MORNING YOU WILL BE PROMPTED FOR PAYMENT INFO…IT IS OFFICIAL IT WAS EVEN ON THE NEWS. FACEBOOK WILL START CHARGING DUE TO THE NEW PROFILE CHANGES. IF YOU COPY THIS ON YOUR WALL YOUR ICON WILL TURN BLUE AND FACEBOOK WILL BE FREE FOR YOU. PLEASE PASS THIS MESSAGE ON IF NOT YOUR ACCOUNT WILL BE DELETED IF YOU DO NOT PAY.”

Mashable.Com has reported that the widespread rumor is just that, a rumor.  Despite the recent changes, Facebook continues to maintain on its homepage, “It’s free and always will be.”

After all, Facebook is expected to generate over $4 billion in advertising revenue in 2011.  They would not be able to do this as a paid subscription service.  Users would abandon them in droves in search of free social networks like Google +

Among the changes revealed last Thursday at the F8 conference in San Francisco, Facebook founder Mark Zuckerberg discussed several new features covering everything from food to music.  One of the new features will provide a complete history of a Facebook users life on their profile page called “Timeline.”

“Timeline” will change a users profile page and will also display a large cover photo dominating it.  Facebook hopes this new service will better express who you are to others.

Even more interesting, “Timeline” will also allow Facebook users to check those who have defriended them.  This service has never before been available.

As a general rule of caution, Facebook users should not believe everything they read on their friends profile wall.  Although your friends may mean well, blindly copying and pasting false warnings and chain letters only allow rumors such as Facebook charging for its service to continue and thrive.

In dispelling other rumors: No, the Google candy available in the media room of the Fox Presidential Debate on Thursday did not contain transmitting devices. Therefore, you will not start glowing in the dark making you more searchable on Google search engines.

This is true – I was there and thoroughly enjoyed the candy bar provided by Google.

Foreclosure Fraud Case Settled at the Florida Supreme Court

In a matter of “great public importance” that has gone largely ignored this week, the high-profile foreclosure fraud case of Roman Pino versus The Bank of New York has been settled.  According to the Florida Supreme Court, the matter was dismissed upon Pino’s “Notice –Dismiss (Voluntary Stipulation)” on July 25th.

The opportunity for a precedent setting opinion for attorney Thomas Ice, of Ice Legal, whose boutique litigation firm specializes in uncovering forged and fraudulent foreclosure documents, must mean outright success for Pino. 

Although details of the settlement were not provided in the brief stipulation before the high court, one can only speculate whether Pino received a mortgage modification, principal reduction, right to short-sale, waiver of deficiency balance, or his home free and clear. 

One thing is clear, though.  Any settlement agreement between the parties would contain a confidentiality agreement.

Neither Ice, nor Enrique Nieves – Pino’s attorney of record – were available for comment despite several messages left at Ice Legal and on their cell phone voicemail.

An appeals court in February requested that the Florida Supreme Court consider the case of Greenacres homeowner Roman Pino as a matter of “great public importance.” The decision by the 4th District Court of Appeal in West Palm Beach was unusual as neither the bank nor the homeowner had requested such a review.

“We conclude that this is a question of great public importance, as many, many mortgage foreclosures appear tainted with suspect documents,” the appeals court wrote in certification to the Supreme Court.

Had the matter been adjudicated on its merits and a decision rendered in favor of Pino, thousands of foreclosure cases could have been impacted as allegations of document fraud and robo-signing run rampant throughout the nation.

According to land records, Pino purchased his Greenacres home in July, 2006 for $203,000 by securing a $162,400 mortgage with Silver State Financial Systems. After falling behind on the mortgage, the Bank of New York moved to foreclose in October, 2008.

In their foreclosure complaint, the Bank of New York alleged that it was the owner of Pino’s mortgage note through an assignment from another lender, but did not include said assignment as part of its original complaint.

Pino retained Ice, who in moving to dismiss the complaint, argued that the bank needed an assignment in order to have standing to foreclose.

Attorneys from the Law Offices of David J. Stern in Plantation filed an amended complaint and attached an unrecorded mortgage assignment “which happened to be dated just before the original pleading was filed,” the appeals court wrote.

Stern’s now defunct law firm is one of several foreclosure mills throughout Florida that are under investigation by Florida Attorney General Pam Bondi.

Just as Pino’s attorneys were set to take depositions of Stern employees to determine how the assignment was created, the Bank of New York dismissed its foreclosure action.  Ice had wanted an opportunity to prove that Pino was the victim of fraud but was unable to do so because of the voluntary dismissal. The bank refiled the foreclosure in August 2009, and that case is pending.

In its written opinion, the Fourth District Court of Appeal agreed with the lower court’s ruling about the dismissal but because of its importance on similar foreclosure matters, sent the case to the state’s highest court in Tallahassee. One appellate judge, Gary Farmer, dissented saying he thought the trial judge could have kept the case open to litigate Pino’s claim of fraud.

“I’m not surprised at a settlement of this matter considering the allegations of forged or fraudulent documents and the risk of substantial loss to the bank,” said Carlos J. Reyes, of the Reyes Law Group in Fort Lauderdale.  “As a foreclosure defense attorney, my preference would have been for a written opinion from the Florida Supreme Court, but the client is the ultimate decision maker in any settlement discussions.”
